PREAMBLE

These general terms and conditions of sale (hereinafter the ‘General Terms and Conditions’ or ‘the GTC’) apply to any purchase made by a natural person (hereinafter the ‘Customer’) on the website https://boutique.elysee.fr/ (hereinafter the ‘Site’) from EXPENDO ORGANISATION, a simplified joint stock company with a share capital of 3,000 euros, registered in the Bourges Trade and Companies Register under number 798 334 553, whose registered office is located at Espace Affaires Maryse Bastié - 1 rue Maryse Bastié - 18110 PIGNY - France. Tel.: 02 48 70 40 40, Fax: 02 48 65 87 87 87, email: contact@boutique.elysee.fr (hereinafter ‘EXPENDO ORGANISATION’).

EXPENDO ORGANISATION sells the Élysée store products through the website of the Élysée store.

The purpose of these General Terms and Conditions is to regulate the sale and delivery of Products ordered from EXPENDO ORGANISATION via the Site.

They are accessible and printable at any time via a hypertext link available on the home page of the Site.

 

 

IMPORTANT

Any Order placed on the Site necessarily implies the Customer’s unreserved acceptance of these general terms and conditions

 

Article 1. DEFINITIONS

The terms used below have the following meanings under these General Terms and Conditions:

- ‘Customer’: refers to the contracting party of EXPENDO ORGANISATION, which guarantees to have the status of consumer as defined by French law and jurisprudence. In this respect, it is expressly provided that the Customer acts outside of any usual or commercial activity. 

- ‘Order’: refers to the purchase of Products by a Customer from EXPENDO ORGANISATION.

- ‘Account’: refers to the interface in which all the data provided by the Customer, hosted on the Site, is grouped together. Access to the Account is made using the Customer’s Identifiers.

- ‘Identifiers’: refers to the email address and password chosen by the Customer that is required to access their ACCOUNT on the SITE.

- ‘Delivery’: refers to the first presentation of the Products ordered by the Customer at the delivery address indicated at the time of the Order.

- ‘Products’: refers to all the products offered for sale on the Site by EXPENDO ORGANISATION.

- ‘Site’: refers to the website of the Élysée store, which can be accessed at the following address: https://boutique.elysee.fr/

- ‘Territory’: refers to Metropolitan France, Corsica and the French overseas departments and territories.

 

Article 2. SUBJECT

The purpose of these General Terms and Conditions is to establish the contractual provisions relating to the respective rights and obligations of the Customer and EXPENDO ORGANISATION in connection with the sale of Products.

The Customer has been informed in a clear manner and acknowledges that the Site is intended for consumers.

Article 3. ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS

The CUSTOMER undertakes to read these General Conditions carefully and accept them before proceeding with payment for a Product Order placed on the Site.

These General Terms and Conditions are referenced at the bottom of each page of the Site by means of a link and must be consulted and expressly accepted before placing the Order. The Customer is invited to carefully read through, download, print and keep a copy of the General Conditions.

EXPENDO ORGANISATION advises the Customer to read the General Conditions with each new Order, the latest version of which applies to each new Product Order.

The acceptance of these General Conditions on the Site is brought about by a box that must be actively ticked by the Customer at the time of ordering the Products on the Site.  

By clicking on ‘Order’ and then confirming said Order before proceeding with payment, the Customer acknowledges that they have read, understood and accepted the General Terms and Conditions without limitation or condition.

 

Article 4. REGISTRATION ON THE SITE

Article 4.1. Conditions of registration

To be able to purchase a Product, the Customer must be at least 18 years old and have the legal capacity to do so, or, if they are a minor, they must be able to prove consent from their parents. 

On the Site, by clicking on ‘Create my account’, the Customer will be asked to provide an email address and then complete the form available on the Site. The symbol (*) indicates mandatory fields that must be completed by the Customer in order to register on the Site.

By clicking on ‘register’, the Customer will validate their registration, and will also be asked to register a delivery address and a telephone number.

From the Account, the CUSTOMER may check the status of their Order on the Site.

The tracking of Deliveries can, if necessary, be done using the online tracking tools provided by some carriers. The Customer may also contact EXPENDO ORGANISATION’s sales department at any time by email at sav@boutique.elysee.fr or via the contact form available at the following address: https://boutique.elysee.fr/nous-contacter, to obtain information on the status of their Order.

 

The information that the Customer provides to EXPENDO ORGANISATION when placing an Order must be complete, accurate and up-to-date. EXPENDO ORGANISATION reserves the right to ask the Customer to confirm, by any appropriate means, their identity, eligibility and the information provided.

The Customer undertakes to communicate to EXPENDO ORGANISATION any necessary updates of the data provided at the time of registration.

Article 4.2. Management of Identifiers

The Customer will receive confirmation of their registration at the email address indicated on their registration form.

Once registered, the Customer must go to the Site and log on using their Identifiers. 

The Customer may change their password at any time, via the ‘My Account’ area.

EXPENDO ORGANISATION undertakes not to communicate this password. It is the Customer’s responsibility to ensure the confidentiality of their Identifiers. Any connection to a Customer’s Account using the associated Identifiers will be presumed to have been made by the Customer, who accepts responsibility for it.

Any Customer who becomes aware of fraudulent use of their Identifiers must inform EXPENDO ORGANISATION as soon as possible. Negligence in communicating this alert to EXPENDO ORGANISATION may be blamed on the Customer.

The creation of an Account requires the provision of a valid email address.

The Customer undertakes to create one unique Account on the Site. EXPENDO ORGANISATION declines any responsibility for harmful consequences that the use of multiple Accounts could have for a single Customer.

The Customer is fully responsible for the accuracy and updating of the data provided in connection with the opening and management of his Account.

 

Article 4.3. Unsubscribe 

The Customer may unsubscribe at any time by sending an email to contact@boutique-elysee.fr or via the contact form available at the following address: https://boutique.elysee.fr/nous-contacter. EXPENDO ORGANISATION will delete the ACCOUNT as soon as possible and will send the Customer an email confirming that they have unsubscribed.

 

 

Article 5. PRODUCT ORDER

Article 5.1. Product Features

On the Site, the Products available are:

- Products by the brand ‘Elysée – Présidence de la République’;

- And Palais de l’Elysée and French Republic souvenirs.

Products by the brand ‘Elysée – Présidence de la République’ can be divided into the following categories:

- Fashion;

- Accessories;

- Home;

- Books and stationery;

- Children’s items.

 

All of the Products sold on the Site are made in France.

 

EXPENDO ORGANISATION undertakes to present the essential characteristics of the Products and the mandatory information that the Customer must receive under applicable law on the Product Sheets available on the Site.

The Customer undertakes to read this information carefully before placing an Order on the Site. 

Unless otherwise expressly indicated on the Site, all Products sold by EXPENDO ORGANISATION are new and comply with the European legislation in force and the standards applicable in France.

Article 5.2. Order Procedure

To place an Order, the Customer must follow the steps described below (please note however that depending on the Customer’s start page, the steps may differ slightly).

 

5.2.1. Selection of Products 

 

The Customer must select the Product(s) of their choice by clicking on the Product(s) in question, either by adding it/them to the shopping cart directly from the list of Products suggested, or from the Product Page.

The Customer will then have to choose the desired quantity.

Once the Product has been selected, it is placed in the Customer’s shopping cart.

The Customer can add as many Products to their cart as they wish. However, it is specified that for certain Products, the Customer may not order more than eleven (11) identical items. This information will be brought to the Customer’s attention on the Information Sheet of the Product concerned.

 

5.2.2. Orders 

 

Once the PRODUCTS have been placed in the shopping cart, the Customer must click on the shopping cart and on the ‘Order’ tab.

 

> Step 01 – Summary  

At this point, the summary of the Order is displayed. The Customer is invited to check that the content of the Order is correct.  

At this stage, the Customer has the option to enter a Discount Code by clicking on the ‘Use a Promo Code’ tab.

By clicking on ‘Next’, the Customer will proceed to the next step.

 

> Stage 02 – Login

If the Customer has not already done so, they will be asked to log in or register.

By clicking on ‘create my account’, the Customer will access the registration form in accordance with article 4 of these GTC.

Any Customer who has already registered must provide their email address and password to access their Account.

By clicking on ‘Next’, the Customer will proceed to the next step.

 

> Step 03 – Addresses

The Customer may choose one of the addresses registered when creating their Account or add a new delivery address and/or a new billing address.

By clicking on ‘Next’, the Customer will proceed to the next step.

 

> Step 04 – Delivery

In accordance with Appendix 2 of these GTC, the Customer may choose their delivery method from among the options offered on the Site.

By expressly accepting the General Terms and Conditions of Sale and clicking on ‘Order’, the Customer will proceed to the next step.

 

> Step 05 – Payment

Before paying, the Customer is invited to check the content of their Order (including references, quantity and, if applicable, the size of the Products, the price and the amount of the delivery costs).

For Products for which a number of options are available, these specific references appear when the correct options have been selected. Orders that are placed must include all the information necessary for their processing.

At this stage, the Customer may either click on ‘Continue shopping’ to return to the online shop to continue shopping and/or modify their Order, or proceed to secure payment for the Products by clicking on ‘Pay’, where they will provide all the information necessary for billing and delivery of the Products.  

 

5.2.3. Acknowledgement of Receipt     

Once all the steps described above have been completed, a page appears on the Site to acknowledge receipt of the Customer’s Order. A copy of the acknowledgement of receipt of the Order is automatically sent to the Customer by email, provided that the email address supplied at the time of registration is correct.

 

EXPENDO ORGANISATION does not send any Order confirmations by post or fax.

 

5.2.4. Invoicing     

 

During the Order procedure, the Customer must indicate the information necessary for invoicing (on the Site, the (*) symbol will indicate the mandatory fields that must be completed in order for the Customer’s Order to be processed by EXPENDO ORGANISATION).

In particular, the Customer must clearly indicate all information relating to the Delivery, in particular the exact delivery address, as well as any access code relating to the delivery address.

The Customer must also specify the payment method chosen.

Neither the Order Form that the Customer issues online, nor the acknowledgement of receipt of the Order that EXPENDO ORGANISATION sends to the Customer by email, shall constitute an invoice. Regardless of the method of Order or payment used, the Customer will receive the original invoice upon delivery of the Products inside the package.

 

Article 5.3. Date of the Order

The date of the Order is the date on which EXPENDO ORGANISATION acknowledges receipt of the Order. The time periods indicated on the SITE do not start to run until this date.

 

Article 5.4. Price

For all Products, the Customer will find on the Site the prices displayed in euros including all taxes, as well as the applicable delivery charges (depending on the weight of the package, excluding packaging and gifts, the delivery address and the carrier or mode of transport chosen).

Prices include in particular value added tax (VAT) at the rate in force on the date of the Order. Any change in the applicable rate may affect the price of the Products as from the date of entry into force of the new rate.

The applicable VAT rate is expressed as a percentage of the value of the Product sold.

The prices of EXPENDO ORGANISATION suppliers are subject to change. As a result, the prices indicated on the Site may change. They may also be modified in the event of special offers or sales.

The prices indicated are valid, unless there is a gross error. The applicable price is that which is indicated on the Site on the date on which the Order is placed by the Customer.

 

Article 5.5. Availability of PRODUCTS

The professional undertakes to deliver the Product on the date or within the period indicated to the Customer, unless the Parties have agreed otherwise.

The unavailability of a Product should be indicated on the relevant Product Page. Customers may also be informed of the restocking of a Product by EXPENDO ORGANISATION.

In any event, if the unavailability of a product has not been indicated at the time of the Order, EXPENDO ORGANISATION undertakes to inform the Customer without delay if the Product is unavailable.

In the event that a Product is unavailable, EXPENDO ORGANISATION may, if the parties agree, offer an alternative Product of equivalent quality and price that is acceptable to the Customer.

If the Customer decides to cancel their Order due to Products being unavailable, they will obtain a refund of all sums paid for the unavailable Products no later than thirty (30) days after payment.

ARTICLE 6. PURCHASING A GIFT CARD

The Customer may buy a Gift Card on the Site.

To do so, the Customer must go to the page available at boutique.elysee.fr/carte-cadeau and select the following elements:
- Amount on the Gift Card, among the following proposed amounts: 15 euros, 30 euros, 50 euros, 100 euros, 150 euros or 200 euros

- Gift Card delivery method:
> Digital: the electronic Gift Card will be sent via email to the provided email address;
> Paper: the physical Gift Card will be sent by post to the provided address (a shipping fee of €2 will be charged).

- Gift Card activation date (which may differ from the purchase date).
The Customer is informed that, starting from the activation date, the Gift Card will be valid for one (1) year.

Beyond this expiration date, the Gift Card will no longer be usable and the remaining balance on it will be lost.

 

ARTICLE 7. COLLECTION OF REVIEWS ONLINE

Any Customer has the possibility to leave a review of the Products via the form available under each Product Information Sheet.

As part of the online collection of reviews on the Site, EXPENDO ORGANISATION hereby expressly undertakes to provide users with fair, clear and transparent information on how to publish and process the reviews they are posting online. In this respect, EXPENDO ORGANISATION undertakes in particular to display the date of the review and any updates.

In this respect, it should be noted that EXPENDO ORGANISATION exercises a priori control over these reviews. Thus, EXPENDO ORGANISATION will not publish reviews that include content that is contrary to the laws and regulations in force or to morality, especially forged content, or defamatory or offensive texts or texts that may constitute discrimination, incitement to hatred or violence, invasion of privacy, or endangering minors.

In the event of a review being rejected, EXPENDO ORGANISATION will inform the author of the review within three (3) business days by email, indicating the reasons justifying the rejection.  

As part of the control exercised over the reviews, EXPENDO ORGANISATION undertakes to ensure that the processing of personal data carried out in this context complies with Law No. 78-17 of 6 January 1978 on information technology, files and freedoms as amended and the GDPR.  

The consumer author of the review may not be contacted from the Site.

In any case, the reviews published on the Site may not be modified by their authors.

No consideration is provided by EXPENDO ORGANISATION in exchange for a Customer providing their review.

The maximum period for the publication of a review is fifteen (15) business days.  

The maximum period for keeping a review on the Site is three (3) years  

Thus, any Customer wishing to write to EXPENDO ORGANISATION about a particular review will be invited to write to this address: contact@boutique.elysee.fr or to use the contact form at the following address: https://boutique.elysee.fr/nous-contacter , providing the precise details of the review in question.

 

A posteriori and in the event of a relevant alert, EXPENDO ORGANISATION undertakes to suspend or delete a review only insofar as it:

- Does not respect these General Terms and Conditions of Use;

- Contains offensive, defamatory, racist or illegal content.

 

ARTICLE 8. RIGHT OF WITHDRAWAL

The terms of the right of withdrawal are set out in the ‘Withdrawal Policy’, which is available in Appendix 1 hereto.

 

ARTICLE 9. PAYMENT

Article 9.1. Payment methods

The Customer may pay for their Products online on the Site using the methods offered by EXPENDO ORGANISATION, i.e. by bank card via the secure e-transaction payment module by Crédit Agricole or via the PayPal payment module.

In the case of payment by bank cheque, the Order is put on hold until the cheque is received and cashed upon receipt. The Customer must issue a cheque payable to EXPENDO ORGANISATION and send it by post to: EXPENDO ORGANISATION – Boutique de la Présidence de la République - ZAC de Lizy, 1 rue Maryse Bastié, 18110 PIGNY. An email will be sent to any Customer who chooses to pay by cheque to inform them that their Order is pending until payment is received. Cheques must be issued by a bank domiciled in mainland France.

The Customer may also pay for the Products online using a valid Gift Card. The expiry date is specified on the Gift Card itself, whether it is a physical or an electronic card. The Gift Card may be used in one or several transactions on the website, and any remaining amount due may be paid via another payment method. 

The Customer guarantees EXPENDO ORGANISATION that they hold all the authorisations required to use the chosen payment method.

EXPENDO ORGANISATION will take all necessary measures to guarantee the security and confidentiality of data transmitted online as part of online payments on the Site.

It is hereby specified that all payment information provided on the Site is transmitted to the Site’s bank and is not processed on the Site.

 

Article 9.2. Payment date

In the event of a one-time payment by credit card, the Customer’s account will be debited when the Products are shipped.  

In the event of partial delivery, the total amount will be debited from the Customer’s account when the first package is shipped at the earliest. If the Customer decides to cancel their Order as the Products are unavailable, the refund will be made in accordance with the last paragraph of Article 5.5 of these General Terms and Conditions.

 

Article 9.3. Delay or refusal of payment

If the bank refuses to charge a card or other means of payment, the Customer must contact EXPENDO ORGANISATION’s Customer Service Department in order to pay for the Order by any other valid means of payment.

In the event that, for any reason whatsoever – opposition, refusal or otherwise – the sending of money due by the Customer proves impossible, the Order will be cancelled and the sale automatically terminated.

 

ARTICLE 10. PROOF AND ARCHIVING

Any contract concluded with the Customer corresponding to an Order for an amount exceeding 120 euros including VAT will be archived by EXPENDO ORGANISATION for a period of ten (10) years in accordance with Article L. 213-1 of the Consumer Code.

EXPENDO ORGANISATION agrees to archive this information in order to monitor transactions and produce a copy of the contract at the Customer’s request.

In the event of a dispute, EXPENDO ORGANISATION will have the opportunity to prove that its electronic tracking system is reliable and that it guarantees the integrity of the transaction.

 

ARTICLE 11. TRANSFER OF OWNERSHIP

EXPENDO ORGANISATION remains the owner of the delivered Products until they have been fully paid for by the Customer.

The above provisions shall not prevent the transfer to the CUSTOMER, at the time of receipt by them or by a third party designated by them other than the carrier, of the risks of loss or damage to the Products covered by the retention of title, as well as the risk of damage to which they may give rise.

 

ARTICLE 12. DELIVERY

The terms and conditions for the Delivery of the Products are set out in the ‘Delivery Policy’ referred to in Appendix 2 hereto.

 

ARTICLE 13. PACKAGING

The Products will be packed in accordance with the transport standards in force, in order to guarantee maximum protection for the Products during Delivery.

Customers undertake to comply with the same standards when returning Products under the conditions set out in Appendix 1 – Withdrawal Policy.

 

ARTICLE 14. GUARANTEES

In addition to the commercial guarantees that EXPENDO ORGANISATION may offer for certain Products, each Customer benefits from ‘legal’ guarantees for all the Products, which are detailed below, in accordance with Article L.111-1 of the Consumer Code.

Article 14.1. Compliance guarantee

 

Article L. 217-4 of the Consumer Code:The seller delivers a product conformant to the contract and is responsible for any conformity faults which exist at the time of delivery.
The seller must also take responsibility for conformity faults resulting from the packaging, instructions for assembly or installation when these have been made their responsibility by the contract or have been produced under their responsibility
.’

 

Article L.217-5 of the Consumer Code:The goods are in conformity with the contract:
1° If they are suitable for the purpose usually associated with such a product and, if applicable:
- if they correspond to the description given by the seller and have the features that the seller presented to the buyer in the form of a sample or model;
- if they have the qualities that a buyer can legitimately expect in view of public statements made by the seller, producer or their representative, in particular in terms of advertising or labelling;
2° Or if they have the features defined by mutual agreement between the parties or are suitable for any special requirement of the buyer which was made known to the seller and to which the latter agreed.

 

EXPENDO ORGANISATION is likely to be liable for conformity faults resulting from the packaging, instructions for assembly or installation when these have been made their responsibility or have been produced under their responsibility.

 

The action resulting from a conformity fault lapses two (2) years after the delivery of the Product (Article L.217-12 of the Consumer Code)

In the event of a conformity fault, the Customer may request the replacement or repair of the Product, at their choice. However, if the cost of the Customer’s choice is clearly disproportionate to the other possible option, taking into account the value of the Product or the seriousness of the fault, EXPENDO ORGANISATION may proceed with a refund without following the option chosen by the Customer.

In the event that a replacement or repair is impossible, EXPENDO ORGANISATION undertakes to refund the price of the Product within thirty (30) days of receipt of the returned Product and in exchange for the return of the Product by the Customer to the following address: Expendo Organisation - Boutique de la Présidence de la République - 1 Rue Maryse Bastié, 18110 Pigny, France.

Finally, the Customer is exempt from providing proof of the existence of the Product’s conformity fault for the twenty-four (24) months following the delivery of the Product, except for second-hand goods, for which this period is set at six (6) months. (Article L. 217-7 of the Consumer Code).

 

It is specified that this legal guarantee of conformity applies independently of the commercial warranty that is granted, if any should exist, with respect to the Products.

 

Article 14.2. Guarantee of hidden defects

 

EXPENDO ORGANISATION is bound by the guarantee for hidden defects in the Product sold that make it unfit for the use for which it is intended, or that reduce this use to such an extent that the Customer would not have acquired it, or would have at a lower price, had they known of them. (Article 1641 of the Civil Code)

 

This guarantee allows a Customer who can prove the existence of a hidden defect to choose between the refund of the price of the Product if it is returned or the refund of part of its price if the Product is not returned.

In the event that a replacement or repair is impossible, EXPENDO ORGANISATION undertakes to refund the price of the Product within thirty (30) days of receipt of the returned Product and in exchange for the return of the Product by the Customer to the following address: EXPENDO ORGANISATION – Boutique de la Fondation Belem- 1 rue Maryse Bastié –– 18110 PIGNY - France. The action resulting from hidden defects must be brought by the buyer within a period of two years following the discovery of the defect. (Paragraph 1 of Article 1648 of the Civil Code).

 

 

ARTICLE 15. RESPONSIBILITY

EXPENDO ORGANISATION will under no circumstances be held liable in the event of non-performance or improper performance of contractual obligations attributable to the Customer, in particular when entering their ORDER.

EXPENDO ORGANISATION will not be held liable, or considered to have failed hereunder, for any delay or non-performance when the cause of the delay or non-performance is related to a case of force majeure as defined by the case law of the French courts and tribunals.

It is also specified that EXPENDO ORGANISATION does not control the Websites that are directly or indirectly linked to the Site. Consequently, it does not accept any liability for the information published on them. Links to third party websites are provided for information purposes only and no guarantee is given as to their content.

 

Article 16. FORCE MAJEURE

EXPENDO ORGANISATION may not be held liable if the non-performance or delay in the performance of one of its obligations described in these GTC results from a case of force majeure.

Force majeure in contractual matters occurs when an event beyond the debtor’s control, which could not reasonably have been foreseen at the time the contract was concluded and whose effects cannot be avoided by appropriate measures, prevents the debtor from performing their obligation.

If the impediment is temporary, performance of the obligation shall be suspended unless the resulting delay justifies termination of the contract. If the impediment is definitive, the contract is automatically terminated and the parties are released from their obligations under the conditions provided for in Articles 1351 and 1351-1 of the Civil Code.

As such, EXPENDO ORGANISATION will not be held liable in particular in the event of an attack by hackers; unavailability of equipment, supplies, spare parts, personal or other equipment; interruption of electronic communications networks; as well as in the event of the occurrence of any circumstance or event beyond the control of EXPENDO ORGANISATION occurring after the GTC are signed that prevents performance under normal conditions. 

It is specified that, in such a situation, the Customer may not claim any compensation and may not bring any action against EXPENDO ORGANISATION.

In the event of one of the above-mentioned events, EXPENDO ORGANISATION will endeavour to inform the CUSTOMER as soon as possible.

 

ARTICLE 17. PERSONAL DATA

EXPENDO ORGANISATION collects personal data on the Site concerning its Customers, including through the use of cookies. Customers can disable cookies by following the instructions provided by their browser.

The data collected by EXPENDO ORGANISATION is used to process Orders placed on the Site, manage the Customer’s account, analyse Orders and, if the Customer has expressly chosen this option, send them sales offer letters, newsletters from the Présidence de la République and the store, promotional offers and/or information on special sales, unless the CUSTOMER no longer wishes to receive such communications from EXPENDO ORGANISATION.

The CUSTOMER’s data is kept confidential by EXPENDO ORGANISATION for the purposes of the contract, its execution and in compliance with the law.

CUSTOMERS may unsubscribe at any time by accessing their ACCOUNT or by clicking on the hypertext link provided for this purpose at the bottom of each offer received by email.

The data may be communicated, in whole or in part, to the EXPENDO ORGANISATION service providers involved in the Order process.

In this respect, the Customer is invited to consult the Privacy Policy accessible at https://boutique.elysee.fr/content/15-donnees-personnelles, which will offer more information about the protection of personal data and the processing carried out via the Site.

In accordance with Law No. 78-17 of 6 January 1978 on information technology, data files and civil liberties and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (General Data Protection Regulation known as GDPR), EXPENDO ORGANISATION ensures the implementation of the rights of the persons concerned.

It should be noted that a Customer whose personal data is processed has the right to access, rectify, update, transfer and erase information concerning them, in accordance with the provisions of Articles 39 and 40 of the amended Data Protection Act, and the provisions of Articles 15, 16 and 17 of the European General Data Protection Regulation (GDPR).

In accordance with the provisions of Article 38 of the amended Data Protection Act and the provisions of Article 21 of the GDPR, the Customer may also, for legitimate reasons, object to the processing of data concerning them without reason and without charge.

ARTICLE 19. INTELLECTUAL PROPERTY

All visual and audio elements of the website, including the underlying technology used, are protected by copyright, trademark and/or patent law.

These elements are the exclusive property of EXPENDO ORGANISATION and the Présidence de la République.

Anyone who publishes a website and wishes to create a direct hypertext link to the Site must ask EXPENDO ORGANISATION and/or the Présidence de la République for permission in writing.

This authorisation from EXPENDO ORGANISATION and/or the Présidence de la République will under no circumstances be granted definitively. This link must be removed at the request of EXPENDO ORGANISATION and/or the Présidence de la République.  Hypertext links to the Site that use techniques such as framing or in-line linking are strictly prohibited.

Any representation or reproduction, in whole or in part, of the Site and its content, by any means whatsoever, without the express prior authorisation of EXPENDO ORGANISATION and/or the Présidence de la République is prohibited and shall constitute an infringement punishable under Articles L. 335-2 et seq. and Articles L. 713-1 et seq. of the Intellectual Property Code.

Acceptance of these GTC constitutes recognition by the Customer of EXPENDO ORGANISATION’s and/or the Présidence de la République’s intellectual property rights and commitment to respecting them.

 

ARTICLE 20. VALIDITY OF THE GENERAL TERMS AND CONDITIONS

Any modification of the legislation or regulations in force, or any decision of a competent court invalidating one or more clauses of these General Terms and Conditions shall not affect the overall validity of these General Terms and Conditions. Such modification or decision shall in no way entitle Customers to disregard these General Terms and Conditions.

Any terms and conditions not expressly provided for herein shall be governed in accordance with the practice of the retail trade sector for companies whose registered office is located in France.

 

ARTICLE 21. MODIFICATION OF THE GENERAL TERMS AND CONDITIONS

These General Terms and Conditions apply to all online purchases made on the Site, as long as the Site is available online.

The General Terms and Conditions are dated in a precise manner and may be modified and updated by EXPENDO ORGANISATION at any time. The applicable General Conditions are those in force at the time of the Order.

The modifications made to the General Conditions will not apply to Products already purchased.

 

ARTICLE 22. JURISDICTION AND APPLICABLE LAW

These General Terms and Conditions and the relationship between the Customer and EXPENDO ORGANISATION are governed by French law.

In the event of a dispute, the French courts shall have sole jurisdiction.

However, prior to any recourse to the arbitral or state judge, the CUSTOMER is invited to contact the EXPENDO ORGANISATION complaints department.

If no agreement is reached or if the Customer justifies having previously attempted to resolve their dispute directly with EXPENDO ORGANISATION by means of a written complaint, then an optional mediation procedure will be proposed and conducted in a spirit of loyalty and good faith with a view to reaching an amicable agreement in the event of any dispute relating to this contract, including its validity.

To initiate this mediation, the Customer may contact the EXPENDO ORGANISATION mediator:

 

CONSUMER MEDIATION SERVICE: 

Amicable settlement of disputes between EXPENDO ORGANISATION and the consumer in accordance with Articles L611-1 to L 641-1 and R 612-1 to R 616-2 of the Consumer Code. In the event of unresolved disputes between EXPENDO ORGANISATION and the Consumer, the Consumer may refer the matter to the Consumer Mediator.

Before referring the matter to the Consumer Mediator, the consumer must have attempted to resolve the dispute directly with the company EXPENDO ORGANISATION by a written  complaint  or have made a complaint under the terms of the contract concluded with EXPENDO ORGANISATION. Consumer mediation is an out-of-court settlement of consumer disputes. If the conditions are met, a consumer mediation will take place according to a precise process and according to the texts in force. The procedure is free of charge for the consumer (R612-1 of the Consumer Code).

IMPORTANT:

Never send original documents to the consumer mediator. Please make photocopies or scan your documents. Never send defective or disputed items or items for reimbursement to the consumer mediator.

The party wishing to implement the mediation process must first inform the other party by registered letter with acknowledgement of receipt, indicating the components of the conflict.

As mediation is not mandatory, the Customer or EXPENDO ORGANISATION may withdraw from the process at any time.

In the event that mediation fails or is not considered, the dispute that may have given rise to mediation will be referred to the competent court designated above.

 

 

APPENDIX 1 - WITHDRAWAL POLICY

 

Principle of withdrawal

 

The Customer has the right to withdraw by sending back or returning the Product to EXPENDO ORGANISATION. 

To do so, the Product must be sent back or returned without undue delay, and at the latest within fourteen (14) days following the communication of the decision to withdraw, unless EXPENDO ORGANISATION offers to recover the Product itself.

 

Withdrawal period

In accordance with Article L.221-18 of the Consumer Code, the withdrawal period expires fourteen (14) days after the day on which the Customer, or a third party other than the carrier and one which is designated by the Customer, physically takes possession of the Product.

In the event that the Customer has ordered several Products via a single Order resulting in several Deliveries (or in the case of an Order for a single Product delivered in several batches), the withdrawal period shall expire fourteen (14) days after the day on which the Customer, or a third party other than the carrier and one which is designated by the Customer, physically takes possession of the last Product delivered.

 

Notification of the right of withdrawal

In order for the withdrawal period to be respected, the Customer must send a communication relating to the exercise of the right of withdrawal before the expiry of the withdrawal period.

 

Effects of withdrawal

In the event of withdrawal by the Customer, EXPENDO ORGANISATION undertakes to refund all sums paid, including delivery costs (with the exception of additional costs resulting, where applicable, from the Customer’s choice of a delivery method other than the standard delivery method proposed by EXPENDO ORGANISATION).

This refund will be made without undue delay and, in any event, no later than fourteen (14) days from the day on which EXPENDO ORGANISATION receives the returned Product. (Article L.221-24 of the Consumer Code)   

EXPENDO ORGANISATION may defer the refund until the Product is received or until the Customer has provided proof of shipment of the goods, whichever comes first.

Thus, in the event that the Customer exercises the right of withdrawal, they will only have to bear the cost of returning the Products.

EXPENDO ORGANISATION will carry out a refund using the same method of payment as the Customer used for the initial transaction, unless the Customer expressly agrees to a different method, and in any case, this refund shall not entail any costs for the Customer.

Should part of all of the initial transaction have been paid for with a Gift Card, the corresponding refund will be made on the Gift Card. 

  

Methods of return

The Customer shall, without undue delay and in any event, no later than fourteen (14) days after notification of their decision to withdraw from this contract, return the goods to: EXPENDO ORGANISATION – Boutique de la Présidence de la République - 1 rue Maryse Bastié –18110 PIGNY.

This deadline is deemed to have been met if the Customer returns the goods before the expiry of the fourteen (14) day deadline.

 

Return costs

The Customer shall bear the direct costs of returning the goods.

In the event that the weight of the Product prevents the Customer from returning it by post, the Customer shall bear the direct costs of returning the goods by another means.

 

Condition of the returned goods

The Product must be returned in accordance with EXPENDO ORGANISATION’s instructions and include all the supplied accessories.

 

A copy of the invoice must be attached to the returned Product.

 

The Customer is only liable for the depreciation of the goods resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of this Product. In other words, the Customer may test the Product but will be held responsible if they carry out any handling other than that which is necessary.

 

Exclusions from the right of withdrawal

The right of withdrawal is excluded in the following cases:

  • Supply of goods or services whose price depends on fluctuations in the financial market
  • Supply of goods made according to the CUSTOMER’s specifications or that are clearly personalised
  • Supply of goods likely to deteriorate or expire quickly
  • Supply of sealed audio or video recordings or software that have been unsealed after delivery
  • Newspapers, periodicals, magazines (except subscription contracts)
  • Provision of accommodation services other than for residential purposes, transport of goods, car rental, catering or services related to leisure activities if the offer provides for a specific date or period of performance
  • Supply of goods which by their nature are inseparably associated with other articles
  • Supplies of sealed goods that cannot be returned for health or hygiene reasons and that have been unsealed by the Customer after Delivery
  • Supply of alcoholic beverages whose price was agreed at the time of conclusion of the sales contract, the delivery of which can only be made after 30 days and whose real value depends on fluctuations in the market beyond the control of EXPENDO ORGANISATION
  • Provision of paperless non-delivered digital content if the execution of which has started with the express prior consent of the consumer, who has also acknowledged that he will thus lose his right of withdrawal
  • Contracts concluded at a public auction.

 

 

APPENDIX 2 - DELIVERY POLICY

Delivery area

The Products offered can only be delivered within the Territory. It is impossible to place an Order for any delivery address outside this Territory.

The Products are shipped to the delivery address(es) indicated by the Customer during the Order process.

 

Shipping time

The deadlines for preparing an Order and then issuing the invoice, before shipping the Products in stock, are mentioned on the SITE.

An email will automatically be sent to the Customer when the Products are shipped, provided that the email address given in the registration form is correct.

 

Delivery Times & Costs

During the Order process, EXPENDO ORGANISATION informs the Customer of the possible delivery times and shipping options for the Products purchased.

Shipping costs are calculated according to the delivery method. The amount of these costs will be due by the Customer in addition to the price of the Products purchased. Details of delivery times and costs are indicated on the Site.

In the event of shipment to French overseas departments and territories, it is specified that the price will be automatically calculated excluding tax on the invoice. Customs duties or other local taxes may be payable. These duties and sums are not the responsibility of EXPENDO ORGANISATION. These rights, declarations, administrative procedures and expenses will be taken on by the Customer, and this shall fully be their responsibility.

In the absence of an indication or agreement as to the delivery date, EXPENDO ORGANISATION shall deliver the Product without undue delay and at the latest thirty (30) days after entering into the contract. (Article L. 216-1 of the ConsumerCode).

 

Terms of Delivery

To ensure delivery, EXPENDO ORGANISATION uses the following service providers:

Once the package has been prepared by EXPENDO ORGANISATION, it will be delivered to you within an indicative period of 48 hours, directly to your mailbox. If the mailbox is not wide enough and you are away, a delivery note will be left at the delivery address, allowing you to choose a new delivery date online within 6 working days or to pick up your package the next day at the post office of your choice from 3 p.m.

If you do not specify your choice, you can pick up your package at your local post office within 15 days.

Once the package has been prepared by EXPENDO ORGANISATION, it will be delivered to you within an indicative period of 48 hours by recorded delivery. If you are away, a delivery note will be left at your delivery address allowing you to choose a new delivery date online within 6 working days or to pick up your package the next day at the post office of your choice from 3 p.m.

If you do not specify your choice, you can pick up your package at your local post office within 15 days.

The package will be delivered to the Customer with recorded delivery and upon presentation of an identity document.

 

If the Customer is absent, a delivery notification note will be left at the delivery address in order to allow them to pick up their package from the post office.

 

If the characteristics of the Product do not allow it to be left in a post office, the carrier will contact the Customer as soon as possible in order to arrange a delivery appointment, at the latest thirty (30) days from the date of validation of the Order. In the event that the day and time of the Delivery is not fixed in advance and previously accepted, the Customer must contact EXPENDO ORGANISATION’s Customer Service to set a new delivery date. DELIVERY problems

The Customer is informed of the delivery date set at the time of choosing the delivery method, at the end of the Online Order procedure, and before confirming the Order.

 

In the absence of any indication as to the delivery time, it is specified that the Deliveries will be made within thirty (30) days maximum. Failing this, the Customer must give EXPENDO ORGANISATION formal notice to deliver within a reasonable time and in the event of non-delivery within this time, may terminate the contract.  

 

EXPENDO ORGANISATION will refund the Customer, without undue delay from the receipt of the termination letter, the total amount paid for the Products, including taxes and shipping costs, using the same method of payment as the one used by the Customer to purchase the Products.

 

EXPENDO ORGANISATION is responsible until the Delivery of the Product to the Customer.

 

It should be noted that the Customer has a period of three (3) days to notify the carrier of any damage or partial loss noted at the time of Delivery.
